An 18-year-old decides to become a serial killer. To get closer to this goal, the man decides to kill a random person first.
In the Rahmer Forest in the north-west of Dortmund, he looks for his victim: Mark*. Mark is riding his bike through the forest at the time. He decides to take a break. He leans against his bike, lights a joint and looks at his mobile phone.
Just then, the perpetrator decides to attack Mark. He pulls out his knife and attacks him out of nowhere, wounding him with the knife. The victim survives seriously injured.
The perpetrator is already undergoing psychological treatment at the time. He tells his psychiatrist at the LWL clinic in Marl-Sinsen about his plans to attack other people in order to kill them - to become a serial killer.
The psychiatrist decides to break his duty of confidentiality and reports him to the police. Was the psychiatrist allowed to break his duty of confidentiality?
